1. Introduction
Welcome to Ujumaa Platforms, also referred to as “Uju”, “we”, “us”, or “our”.
These Terms of Use explain the rules and conditions for using the Uju Bulk SMS Platform. By creating an account, accessing, or using our services, you agree to these Terms. If you do not agree, please do not use the Platform.
2. About the Service
Uju provides a Bulk SMS communication platform that allows users to send SMS messages to mobile phone numbers provided by the user. Our services may include:
- Bulk and transactional SMS
- Message scheduling
- Delivery reports
- Sender ID management
- API integrations
We act only as a technology platform, not as the sender or author of message content.
3. Eligibility to Use Uju
To use Uju, you must:
- Be at least 18 years old
- Have the legal authority to send SMS messages
- Provide accurate registration information
- Use the Platform in compliance with applicable laws
We reserve the right to refuse, suspend, or terminate access if these requirements are not met.
4. User Responsibilities
By using Uju, you agree that you will:
- Send messages only to recipients who have given clear consent (opt-in)
- Maintain accurate and lawful contact lists
- Include opt-out instructions such as “Reply STOP to unsubscribe”, where applicable
- Use the Platform responsibly and lawfully
- Keep your login credentials secure and confidential
You are fully responsible for all messages sent through your account.
5. Acceptable Use Policy (AUP)
You must not use Uju to send messages that are:
- Spam or unsolicited messages
- Misleading, deceptive, or fraudulent
- Impersonating another person or organization
- Abusive, threatening, hateful, or offensive
- Related to illegal goods, services, or activities
- In violation of mobile network operator rules
Uju may block, filter, or terminate traffic that violates this policy without prior notice.
6. Compliance with Laws and Regulations
You agree to comply with all applicable laws and regulations, including but not limited to:
- Kenya Data Protection Act, 2019
- Communications Authority of Kenya (CAK) regulations
- Consumer protection and anti-spam laws
- Any applicable international data protection laws
Failure to comply may result in account suspension, termination, or legal action.
7. Sender ID Policy
- Sender IDs must be accurate, non-misleading, and lawfully owned or authorized
- Sender IDs are subject to approval by:
- Uju
- Mobile network operators
- Regulatory authorities
- Approval is not guaranteed
- Uju reserves the right to disable or revoke any Sender ID at any time
8. Message Content Review
Uju reserves the right (but not the obligation) to review, filter, or block message content that:
- Violates these Terms
- Poses regulatory or reputational risk
- Is flagged by carriers or authorities
9. Delivery and Service Availability
- SMS delivery depends on mobile network operators and external systems
- Delivery is not guaranteed
- Delays, failures, or duplicate messages may occur
- Uju is not responsible for issues beyond its reasonable control
10. Fees, Billing, and Credits
- Users are responsible for all charges incurred on their accounts
- Purchased SMS credits are non-refundable, unless required by law
- Pricing may change with reasonable notice
- Unused credits may expire as communicated on the Platform
11. Data Protection and Privacy
Uju is committed to protecting personal data.
- We process personal data in accordance with our Privacy Policy
- Users are responsible for ensuring they have lawful consent to process recipient data
- We implement reasonable security measures to protect stored data
12. Account Suspension and Termination
Uju may suspend or terminate your account if you:
- Violate these Terms or policies
- Send prohibited or abusive traffic
- Fail to comply with legal or regulatory requirements
- Pose a risk to Uju, carriers, or recipients
Termination may occur without prior notice in serious cases.
13. Limitation of Liability
To the maximum extent permitted by law:
- Uju provides the Platform “as is”
- We are not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid by you in the previous billing period
14. Indemnification
You agree to indemnify and hold harmless Uju from any claims, damages, penalties, or losses arising from:
- Your use of the Platform
- Your message content
- Your violation of laws or third-party rights
15. Changes to These Terms
We may update these Terms from time to time. Continued use of Uju after changes means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws of the Republic of Kenya, without regard to conflict of law principles.
